Membership Agreement

MEMBERSHIP AGREEMENT
This Membership Agreement and Terms of Use (“Agreement”) is entered into between Turanlar Tekstil İnşaat Gıda Turizm
Ticaret Limited Şirketi (“Company”) and any real or legal person (“Member” or “User”) who registers by completing the membership process on the website named https://www.itsbasic.com/ and its mobile
applications (“Site”) or uses the Site in any way. The Member hereby declares and undertakes that by accessing the Site
or creating a membership account, they have read, understood, accepted the provisions of this Agreement, and will act in accordance with these provisions. Individuals who do not wish to be bound by the terms determined by the Company
should not use the Site and should terminate their membership.
The Company reserves the right to change, update, or terminate the terms of this Agreement, the services offered, and membership programs without prior notice. The publication of the changes on the Site is the sole and sufficient condition for them to become effective. The User’s continued use of the Site will mean that the changes have been accepted. While the Company takes necessary measures to ensure the accuracy and timeliness of the information provided on the Site, it does not guarantee that the information will always be complete, accurate, and up-to-date.
The information provided by the Member in the membership form will be processed for the purpose of operating the program, ensuring order and delivery processes, and conducting personalized campaign and marketing activities; detailed information can be accessed via the Privacy Policy on the Site. The Member accepts the processing of their personal information within this scope and being contacted via SMS, email, call, or other communication tools. However, they reserve the right to withdraw this consent at any time.
All rights to the Site belong to the Company. The User agrees to use the Site only for personal purposes, not to provide false, incomplete, or misleading information, and not to share content that is illegal or immoral. The User may not share or transfer their username and password information to third parties. They are solely responsible for the security of this information. The User may not use information belonging to others without permission, attempt to gain unauthorized access to systems, or undertake any action that threatens the security of the Site. Unauthorized copying, reproduction, use for commercial purposes, or transfer of Site content to third parties is prohibited.
The Member agrees to comply with the Turkish Penal Code, Turkish Commercial Code, Law on Intellectual and Artistic Works, Industrial Property Law, Code of Obligations, Law No. 6698 on the Protection of Personal Data, and all other applicable legislation while using the Site. In the event of non-compliance, all legal, criminal, and financial responsibility shall belong to the Member. If the Member acts contrary to the provisions of this Agreement or the rules announced on the Site, the Company may partially or completely block the Member's access to the Site, suspend, or completely cancel their membership.
The Company may keep users’ IP addresses, site usage movements, and log records in order to ensure system security, improve the functioning of the Site, manage campaigns, and fulfill its legal obligations. This information may be used for statistical analysis, marketing, market research, or database creation without revealing the identity of the users. The Company takes the necessary technical and administrative measures in accordance with the KVKK (Personal Data Protection Law) and processes the personal data of its members only for specified purposes and does not share it with third parties.
The Member is responsible for ensuring that the payment information they use for purchases made through the Site is accurate, current, and complete. Any consequences and liabilities that may arise due to unauthorized or unlawful use of payment instruments by third parties belong directly to the Member.
Our Company does not in any way view, record, or process credit card or debit card information. Such transactions are carried out online solely between the relevant banks and card organizations and the Member. Sensitive data such as card passwords do not reach our Company's systems.
The Privacy Policy, Terms of Use, and related clarification texts on the Site apply to the confidentiality, security, storage, processing, use, and destruction of Member information and commercial electronic communications.
For the security of the information shared and transactions carried out by members, technical and administrative measures appropriate to the nature of the information have been taken by our Company or relevant service providers. Credit card transactions and approval processes are carried out independently through banks and card organizations. Data entered during membership, shopping, or information updates, and sensitive card information, cannot be viewed by other internet users.
In cases where legal regulations require, member information may be shared with authorized authorities.
Members can stop commercial electronic messages at any time and without having to provide any reason, either by requesting through our communication channels or through systems provided by authorized authorities. Upon this notification, commercial communications made through the relevant channels will be cut within the legal period (transaction and notifications within the scope of legal obligations will continue).
Members can delete cookies or turn off notifications from their device's operating system or browser settings.
For members who update any personal data, including contact information, through the Site, previous consents for personal data processing and commercial electronic communication remain valid for new/updated information. Members who stop commercial communication for a specific channel or make a refusal notification will start receiving messages within the framework of the new consent when they re-authorize communication for that channel from their membership account, regardless of previous refusal records. This situation continues until the member changes their communication preferences again or makes a proper refusal notification.
The Company cannot be held responsible for direct or indirect damages that may arise from technical failures, internet outages, malware infections, or user-sourced errors that may occur during the use of the Site. The Member accepts that they will not demand any material or moral compensation from the Company for this reason.
The Company reserves the right to change, stop, suspend, or completely remove the services, content, and programs on the Site without prior notice. Furthermore, in cases of force majeure (natural disaster, fire, war, riot, terrorist attack, strike, lockout, pandemic, infrastructure and internet failures, power outages, etc.), the parties will not be held responsible if they cannot fulfill their contractual obligations.
The Member can cancel their membership at any time. The Company also reserves the right to terminate membership immediately due to a violation of membership conditions or at its own initiative. When membership is canceled, the Member's right to access the Site ends. The Member accepts that this action is irreversible when they terminate their membership.
Turkish Law shall apply to the resolution of disputes arising from this Agreement, and Istanbul Courts and Enforcement Offices are authorized.
The Member declares and undertakes that when they complete the registration process for the Site or continue to use the Site, they have read, understood, accepted all the terms and conditions in this Agreement, and confirmed the accuracy of the information they provided about themselves. This Agreement comes into force at the moment the Member registers for membership.
